The Supreme Court (SC) on Tuesday declared Islamabad High Court\u2019s (IHC) Sept 16 decision to bar Justice Tariq Mehmood Jahangiri from judicial work \u201cnull and void\u201d, a day after the apex court ordered the decision\u2019s suspension.<\/p>\n
Resuming the hearing today, the five-member constitutional bench \u2014 headed by Justice Aminuddin Khan and comprising Justice Jamal Khan Mandokhail, Justice Muhammad Ali Mazhar, Justice Hassan Azhar Rizvi and Justice Shahid Bilal Hassan \u2014 took up Justice Jahangiri\u2019s petition.<\/p>\n
At yesterday\u2019s hearing, the court issued notices to the Attorney General of Pakistan (AGP) Mansoor Usman Awan and the advocate general of Islamabad to appear for the hearing.<\/p>\n
Today, AGP Awan appeared before the court and said, \u201cA judge cannot be barred from judicial work through an interim order.\u201c<\/p>\n
At this, Justice Aminuddin Khan asked respondent Mian Daud, who had filed the original petition against Justice Jahangiri, for his opinion. In response, Daud said: \u201cI hold the same opinion \u2014 a judge cannot be stopped from judicial work.\u201d<\/p>\n
He added that \u201can order barring a judge from their duties can not be defended.\u201d<\/p>\n
The constitutional bench, noting the SC registrar office\u2019s objections regarding the petition against Justice Jahangiri in the IHC, directed the court to \u201cfirst decide on the objections in the writ petition.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"
